1. Accettazione dei Termini
Partecipando alla trasmissione live (“Trasmissione”), l’utente (“Partecipante”) accetta i seguenti Termini di Servizio di Digital5 Limited (“Conduttore”). Se il Partecipante non accetta questi termini, è invitato a non inviare domande o partecipare alla Trasmissione.
2. Concessione dei Diritti
Inviando una domanda, tramite telefonata in onda, email, messaggio privato, commento o qualsiasi altro mezzo, il Partecipante concede al conduttore della Trasmissione (“Conduttore”) una licenza perpetua, irrevocabile, mondiale, non esclusiva, esente da royalty, e trasferibile per utilizzare, riprodurre, distribuire, mostrare, e creare opere derivate basate sulla domanda inviata, in qualsiasi forma e per qualsiasi scopo, incluso ma non limitato a scopi commerciali.
3. Nessuna Rivendicazione di Diritti d’Autore
Il Partecipante rinuncia a qualsiasi rivendicazione di diritti d’autore o altri diritti di proprietà intellettuale sulla domanda inviata e sulle risposte fornite dal Conduttore durante la Trasmissione. Il Partecipante riconosce che il Conduttore può utilizzare le domande e le risposte in registrazioni integrali, shorts, altri video, trascrizioni, immagini o altro materiale multimediale o di diverso supporto senza dover riconoscere alcun credito al Partecipante.
4. Utilizzo a Scopi Commerciali
Il Partecipante riconosce e accetta che il Conduttore può utilizzare le domande inviate e le risposte fornite per fini commerciali, inclusi ma non limitati a, la monetizzazione dei video, la promozione della Trasmissione, e la creazione di contenuti a pagamento. Il Partecipante rinuncia a qualsiasi compenso o diritto di sfruttamento delle domande inviate e sulle conseguenti risposte fornite, compresi i proventi derivanti da tali utilizzi.
5. Rinuncia ai Reclami Legali
Il Partecipante rinuncia al diritto di presentare qualsiasi reclamo legale per danni o qualsiasi altra forma di compensazione relativa all’invio di domande o alla partecipazione alla Trasmissione. Questo include, ma non è limitato a, reclami per diffamazione, violazione della privacy, o qualsiasi altro diritto personale o di proprietà.
6. Privacy e Dati Personali
Il Partecipante accetta che qualsiasi informazione personale e/o sensibile fornita durante l’invio delle domande può essere utilizzata dal Conduttore in conformità con la politica sulla privacy della Trasmissione.
7. Modifiche ai Termini
Il Conduttore riserva il diritto di modificare questi Termini di Servizio, e altre politiche, in qualsiasi momento. È responsabilità del Partecipante verificare periodicamente i Termini di Servizio, e altre politiche, per eventuali modifiche.
8. Controversie
Qualsiasi controversia derivante dalla partecipazione alla Trasmissione sarà risolta in conformità con le leggi della Repubblica di Malta e sarà soggetta alla giurisdizione esclusiva dei tribunali Maltesi.
9. Accettazione Completa
La partecipazione alla Trasmissione implica l’accettazione completa e senza riserve di questi Termini di Servizio e delle politiche del Sito (https://marketingmatematico.mt/privacy-policy/).
Terms of Service for Live Questions
1. Acceptance of Terms
By participating in the live broadcast (“Broadcast”), the user (“Participant”) agrees to the following Terms of Service of Digital5 Limited (“Host”). If the Participant does not accept these terms, they are invited not to submit questions or participate in the Broadcast.
2. Grant of Rights
By submitting a question, whether through an on-air call, email, private message, comment, or any other means, the Participant grants the Host of the Broadcast (“Host”) a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, display, and create derivative works based on the submitted question in any form and for any purpose, including but not limited to commercial purposes.
3. No Copyright Claims
The Participant waives any copyright claims or other intellectual property rights on the submitted question and the responses provided by the Host during the Broadcast. The Participant acknowledges that the Host may use the questions and responses in full recordings, shorts, other videos, transcripts, images, or other multimedia or various media without any credit to the Participant.
4. Use for Commercial Purposes
The Participant acknowledges and agrees that the Host may use the submitted questions and provided responses for commercial purposes, including but not limited to video monetization, promotion of the Broadcast, and creation of paid content. The Participant waives any compensation or exploitation rights of the submitted questions and the consequent responses provided, including the proceeds derived from such uses.
5. Waiver of Legal Claims
The Participant waives the right to file any legal claims for damages or any other form of compensation related to the submission of questions or participation in the Broadcast. This includes, but is not limited to, claims for defamation, invasion of privacy, or any other personal or property rights.
6. Privacy and Personal Data
The Participant agrees that any personal and/or sensitive information provided when submitting questions may be used by the Host in accordance with the Broadcast’s privacy policy.
7. Changes to the Terms
The Host reserves the right to modify these Terms of Service, and other policies, at any time. It is the Participant’s responsibility to periodically review the Terms of Service, and other policies, for any changes.
8. Disputes
Any dispute arising from participation in the Broadcast will be resolved in accordance with the laws of the Republic of Malta and will be subject to the exclusive jurisdiction of the Maltese courts.
9. Full Acceptance
Participation in the Broadcast implies complete and unconditional acceptance of these Terms of Service and the Site’s policies (https://marketingmatematico.mt/privacy-policy/).
